Abstract

The non‐existence of a novum iudicium on the award made by the arbitrator does not affect public policy. Or, in other words, it is not a matter of public policy. Or, in other words, the absence of a novum iudicium on the award rendered by the arbitrator does not give rise to public disorder in arbitration. Nor does the reasoning of the arbitral award affect public policy. Or, in other words, the reasoning of the arbitral award is not a matter related to public order and, therefore, may give rise to public disorder. It is not a matter of public policy.
