Abstract
The paper commences by analysing the characteristics of the symmetry/asymmetry tension in the Spanish autonomous communities model, and the criticism regarding the shortxomings of the proposed model, in particular, from Catalonia. The new Statute rests upon the consideration that, by affecting constitutionality as a whole, its content is not conditioned by the interpretation of the territorial model previously made by the CC. Futhermore, the national character of Catalonia and its historical rights legitimise the differences that are introduced. The Judgment of the Constitutional Court rejects such proposals, underscoring the existence of an autonomous model defined by the Constitution and by the previous interpretations of same made by the CC.
