Resumen
This work analyses the regulation of group actions as established by the Ley de Enjuiciamiento Civil in 2000 - the first general provision for collective actions in Spain. It is argued here that current law is too focused on the protection of consumers and users, and that it should be amended or expanded to apply more generally to other entities and forms of combination, to establish mechanisims for collective compensation and the like. The author, also, expresses doubts about the current position of defendants and the lack of an adequate opportunity for either claimants or defendants to opt out of membership in the group
