Abstract

This thesis analyzes the limits to the waiver to the punishment in transitional justice scenarios. To this end, it addresses the theory of punishment within the framework of widespread and systematic violations of human rights. It further determines whether the reasons behind the awarding of rewarding measures in these contexts can be transferred to scenarios of terrorist violence. It concludes that, despite some shared features, there cannot be an automatic transfer of such waiver
