Abstract

In the last three years, the migratory challenge has emerged as a top priority on the political agenda of the European establishment, but not from a proactive perspective of rigorous analysis of the polyhedral nature of the phenomenon, but from a unidirectional need for greater control and reinforcement of the security of the Member States of the Union in the face of the unstoppable increase in migratory pressure. At the same time, the temporary instruments adopted during the management of the migration crisis, highlighting Decision (EU) 2015/1601, generated demands for re-nationalization of migration policy, led by the Visegrad Group, which have recently received a response in the Judgment of the Court of Justice of 6 September 2017, which calls for the centrality of the principles governing the structural design of the common policy on asylum, immigration and control of external borders: inter-State solidarity and the equity in the distribution of refugee quotas. However, the current systemic impasse in the integration process resulting from the weaknesses of the legal-political model around which it is articulated reproduces its shortcomings beyond the economic link to the point of reaching the European system of international protection.
