Resumen

Desde sus orígenes, el Derecho Internacional Penal ha tenido que lidiar con las amnistías que los Estados adoptaban en sus respectivos territorios para impedir la sanción de los responsables de haber cometido los crímenes más graves que afectan a la comunidad internacional. El presente estudio tiene como objetivo analizar si tras la progresiva evolución de este sector del Ordenamiento Jurídico y, especialmente, después de la adopción del Estatuto de la Corte Penal Internacional, el alcance de las amnistías ha variado. Para ello, en primer lugar, se examina la situación jurídica en la que se encuentran las amnistías en el Derecho Internacional, prestando una atención especial a algunos de los pronunciamientos de los tribunales internacionales de protección de los derechos humanos. A continuación, se centra en el Estatuto de Roma y analiza críticamente la interpretación realizada por la Corte Penal Internacional a propósito de estas medidas. Finalmente, tomando como ejemplo la ley de amnistía aprobada por Colombia, el trabajo muestra las actuales condiciones que parecen exigirse en los procesos de justicia transicional y concluye reflexionando en torno a su validez jurídica.
