Abstract

This paper reflects on the legal implications of the treatment of biological samples and personal data for the purpose of doping control in sport. Over the last few years, doping control in sporting competitions has become a major concern with a significant social impact, given the impact of doping on the health of sportsmen and sportswomen, on the equality of conditions for participants and, finally, as a factor in the “perversion” of the values that are intended to be transmitted through sporting practices. This has led various public and private institutions to develop mechanisms to prevent this practice. It is very opportune for us to consider whether this normative framework and the practice of controls contemplates the more general framework referred to the protection of fundamental rights.
