Abstract
Our legal system has established that legal persons can be convicted in criminal proceedings as criminal defendants for having committed a crime, generating great uncertainty and a great responsibility in the business landscape. In addition, this new criminal responsibility has been established on extremely complex rules and is accompanied by so-called "compliance" plans or criminal prevention plans as organizational tools to mitigate or exempt companies from this special responsibility. In any case, this new criminal liability has reached our legal order to stay and is an essential factor in the management of the risks of business activity, and therefore, must be carefully addressed.
