Abstract

In her commentary the authors summarizes the principle paths of jurisprudence followed in the application of article 336 of the Criminal Code, which prohibits, among other activities, the unauthorized use of poison in hunting. As such, she takes as a point of departure the sentence by a Judge in Zaragoza, later confirmed in appeals, which sentenced two members of a bird breeding for placing poisoned bait with the goal of preventing attacks by avian predators. An especially representative sentence from this reading by Judges and Courts have made in the prohibition contained in this cited precept.
