Abstract

In the Old Regime, the Church and the Estate used the violence against the criminals for consolidate their power and for discipline the society. The criminals were tortured for get their confessions and corporal penalties were publicly used as punishments and to exemplify. In this article, we’ll compare the methods of punishment and tortures used for the common justice and inquisitorial justice in Spain, to observe the similarities and differences between both jurisdictions.
