Abstract

The article examines the Grand Chamber judgment of the Court of Justice of 1 August 2025 (C-600/23, RFC Seraing) on judicial review of CAS awards. The Court holds that Member State courts must be able to verify the compatibility of such awards with the European Union’s public policy. It distinguishes voluntary arbitration from arbitration compelled in sport, acknowledges CAS’s role in ensuring uniformity, and insists that autonomy cannot restrict Charter rights. EU public policy is delineated to include free movement of workers, services and capital. Incidental review is sufficient; national courts may correct an arbitral interpretation, assess its legal consequences, and requalify facts, and they must be able to grant interim relief, disregarding national res judicata rules that would bar review. Belgian law is declared incompatible. The ruling invalidates automatic res judicata for CAS awards within the Union and signals greater judicialization of sports arbitration in Europe, in the future.
