Zusammenfassung
The fees of the insolvency administrators and the fees guarantee account are still unresolved issues in Spain. The present work is limited to estimating the operation of the fees guarantee and to demonstrate its problems with estimated data. The results obtained, which analyze more than 2,500 insolvency proceedings of companies and secondary data from more than 250 administrators, show than the estimated fees guarantee would not cover the entire risk assumed. This denotes the need to address this problem with the revision of the doctrine and jurisprudence to demonstrate the lack of resources of the bankruptcy administrations and provide a solution
