Zusammenfassung

The Achmea case sanctions the hierarchy of the principle of constitutional legality of European Union law in relation to the arbitration clauses provided by the intra-European Union bilateral investment treaties. A judicial decision that corroborates the proposals held by the Commission in its interventions as amicus curiae in relation to this typology of international treaties that came to question the autonomy of the European legal and jurisdictional order. After this ruling, it is questionable whether the consequences of this expected sentence can be extrapolated as such to the mechanism for settling disputes, revamped, investor-state (Investment Court System) provided by the so-called new generation treaties on trade and investment , as is the case of the EU-Canada Comprehensive Economic and Trade Agreement.
