Résumé

Despite recent reforms, the lack of a specific typification for harassment in general continues to be a deficiency in Spanish law, which should be remedied following the best examples of comparative law. Accordingly, the introduction of a new offense type is proposed in which the harassing conduct is considered punishable if the tranquility of the victim is directly and seriously affected or its vital development is badly impaired. All this is considered within the framework of a criminal policy of ultima ratio without ignoring the appropriate civilian instruments.
